Encroachment Application
An encroachment is any structure or feature that is located partly on City property, such as the road allowance or boulevard.
Common examples include:
- Awnings
- Landscaping (for example, gardens or retaining walls)
- Porches or steps
- Part of a building
- Wheelchair ramps or accessibility features
You need an encroachment agreement if part of your property extends onto City-owned land. This is a legal agreement between you and the City of Belleville.
Obtaining an Agreement
1. Confirm if an Encroachment Agreement is Required
You may need an agreement if any part of your structure or landscaping extends onto City land.
If you are unsure, contact us before applying.
2. Review Requirements and Costs
- Application fee: $175 + HST
- Additional conditions may apply depending on the type of encroachment
- The agreement is legally binding
3. Apply
Complete the encroachment application form online.
4. Review and Approval
City staff will review your application. You may be contacted for more information or required documents.
Do not begin any work until your agreement is approved.
Sidewalk Patios
Encroachment agreements are not required for seasonal sidewalk patios in the downtown. You must apply for a patio permit instead.
