Traffic By-law Review

The City of Belleville is reviewing the Traffic By-law (By-law 12967) to ensure regulations remain effective, clear and responsive to current community needs.

Project Overview

The Traffic By-law was passed in 1990 and regulates parking, stopping, traffic controls and the use of municipal roads and parking facilities throughout the city.

This review will:

  • Assess whether current regulations remain appropriate;
  • Identify areas where amendments may be needed;
  • Gather public feedback on parking and traffic-related issues; and
  • Support future recommendations to council.

Vehicles may only be parked or stopped on a highway in the following manner, unless otherwise authorized: 

  • on the right-hand side of the roadway, in the direction of travel; 
  • where there is a raised curb, with the wheels parallel to and not more than 30 centimetres from the curb; 
  • where there is no curb or a rolled curb, with the wheels parallel to and as near as practicable to the edge of the roadway, without parking on a sidewalk, footpath, grassed area, or any part of the highway not intended for vehicle use; 
  • where angle parking is permitted, only at 45 degrees to the curb or as otherwise marked by painted lines, and only within a marked parking space; and 
  • on a one-way street where left-side parking is permitted, only in the prescribed manner, parallel to and close to the left curb or edge of roadway.

No person shall park or stop a vehicle: 

  • on or over a sidewalk or footpath; 
  • opposite, in front of, or within 0.5 metres of a driveway or laneway so as to obstruct its use; 
  • within an intersection, including a roundabout, or on a crosswalk; 
  • within 3 metres of a point on the curb or edge of roadway opposite a fire hydrant; 
  • on a pedestrian crossover or within 9 metres of a pedestrian crossover; 
  • within 9 metres of a crosswalk, including at an intersection; 
  • on any bridge, underpass, or any approach thereto; 
  • in any manner that would obstruct traffic or snow clearing; 
  • in a position that would prevent the convenient removal of another vehicle already parked or standing; 
  • within 2 metres in front of the entrance to a church, hospital, hotel, theatre, hall, or other public building where large numbers of people assemble, except while actively taking on or discharging passengers as permitted; 
  • within 15 metres of the nearest rail of a level railway crossing; 
  • within 15 metres of a roundabout or a signalized intersection; 
  • within 9 metres of the intersection street lines on all approaches and both sides of each approach on a stop street; 
  • within 9 metres of a fire hall on the same side of the highway, or within 30 metres on the opposite side; 
  • in a manner that constitutes double parking; or 
  • outside an area designated by painted lines as a parking space, where such markings are provided. 

Where properly signed, no person shall park: 

  • in spaces reserved for Police vehicles, unless operating an official Police vehicle; 
  • in areas designated as parallel parking only, except in a parallel manner; or 
  • in spaces reserved for the Mayor and Councillors, unless authorized. 

No person shall park a vehicle: 

  • on any highway in the City of Belleville between 1 a.m. and 6 a.m.; 
  • except that, subject to the by-law, vehicles may park between 1 a.m. and 6 a.m. on uncurbed highways only, from April 15 to Nov. 1; or 
  • on any highway for more than 12 consecutive hours. 

No person shall park any portion of a vehicle, including a bicycle, in a designated bicycle lane, except where permitted by a traffic control device, to avoid conflict with traffic, or in compliance with a Police Officer’s direction. 

In metered parking zones, no person shall: 

  • park outside a designated parking space; 
  • park during regulated hours without depositing the required fee or otherwise complying with the meter/payment requirements, unless exempted by permit; 
  • allow a vehicle to remain parked longer than the time paid for; 
  • in a pay-and-display area, park without obtaining and properly displaying a valid pay-and-display ticket; 
  • allow a vehicle to remain parked beyond the expiry time shown on the pay-and-display ticket; or 
  • park in a meter space where the meter has been covered or removed, except where authorized. 

Where properly worded signs are erected and displayed, no person shall stop a vehicle on any highway or part of highway identified in the applicable schedule during the period shown on the signs. 

No person shall park or stop a vehicle on a public street or public place for the purpose of: 

  • repairing the vehicle, except for emergency repairs; 
  • installing equipment, including a radio antenna; or 
  • wrecking any motor vehicle. 

No person shall park or leave a motor vehicle: 

  • on private property without the consent of the owner or occupant; 
  • on property owned or occupied by the Corporation or a local board without consent; or 
  • contrary to posted conditions or prohibitions, in which case the vehicle is deemed to be parked without consent. 

On municipal parking lots, no person shall: 

  • park longer than the posted maximum time limit, or longer than 24 hours where no other limit is posted; 
  • park in a “no parking” area; 
  • park contrary to a pay-and-display ticket requirement; 
  • park in a manner that interferes with snowplowing, snow removal, or civic operations; 
  • park between 5:00 p.m. and 7:00 a.m. where doing so would interfere with snow removal; 
  • park unless the vehicle is entirely within a designated parking space; 
  • park in an area not designated as a parking space; 
  • park in a manner that obstructs an aisle or laneway; 
  • park so as to prevent the removal of another vehicle; 
  • park so as to impede ingress to or egress from a parking space; 
  • park in a pedestrian walkway; 
  • park in an area designated by sign as prohibited, reserved, or subject to a posted time limit, contrary to the sign; 
  • park in a loading bay except while actively loading or unloading as permitted; 
  • park in a fire route; 
  • park in a parking meter space during operating times unless the meter has been properly used, the required fee paid, and the meter activated; or 
  • park in a parking meter space where the meter has been covered. 

No person shall park a vehicle in a designated accessible parking space unless a currently valid accessible parking permit is properly displayed in accordance with the Highway Traffic Act and applicable regulations.

No person shall stop, stand, or park a vehicle: 

  • in a bus stop, unless the vehicle is a bus; 
  • in a school bus loading zone, unless the vehicle is a properly licensed school bus; 
  • in a commercial loading zone, unless permitted by the by-law and only while actively engaged in authorized loading, unloading, or passenger pick-up/drop-off; and in no case for more than 15 consecutive minutes; or 
  • in a taxi loading zone, unless the vehicle is a properly licensed taxi cab; and no taxi cab may remain in a taxi loading zone for more than 15 consecutive minutes.
